Privacy Policy

This Privacy Policy describes how Jakkur Technoparks Private Limited and its affiliates (collectively “Company”) collect, use, share or otherwise process your personal information through its NearShop website at www.nearshop.in (“Website”) and NearShop mobile applications (“Apps”) or any similar platform (hereinafter all collectively referred to as, “the Platform”).

For the purposes of this Privacy Policy, wherever the context so requires “you”, or “user” (or any variation thereof), shall mean any natural or legal person (including any legal heirs, administrators or successors) who has agreed to become a user of the Platform by accessing or using the Platform and registering as a user either as a Merchant or Buyer on the Platform providing the required registration data. Unless the context otherwise requires, “we”, “us”, “our” or “Company” shall mean Jakkur Technoparks Private Limited or any of its assigns, whether now or in the future.

By visiting our Platform you expressly agree to these terms of privacy policy (“Privacy Policy”) and the terms and conditions of use (“Terms of Use”) (collectively “User Agreement”) and other policies of the Company as available on the Platform (“Policies”). You hereby consent to our use of your personal information (including sensitive personal information) in accordance with this Privacy Policy, as may be amended from time to time by us at our discretion. You agree and consent to us collecting, storing, processing, transferring, and sharing your Personal Information (including sensitive personal information) with Merchants, third parties or service providers for the purposes set out in this Privacy Policy. By the use of our Platform you agree to be governed by the laws of India including but not limited to the laws applicable to data protection and privacy. If the User does not agree with these terms of Privacy Policy, the User is advised to refrain from using the Platform.

The Personal information collected in accordance to this Privacy Policy is collected by the Company with its registered office at G 5, Swiss Complex, 33, Racecourse Road, Bangalore – 560001, Karnataka, India.

Our Privacy Policy explains how we collect, use, disclose, and protect your Personal information to provide, develop, and improve our service and, and your choices about the collection and our use of your Personal information. This policy sets out how we collect and use the personal information that we collect about you when you use the Platform. We collect both information that is directly provided by you to us, during sign up such as personal information that you submit when you visit and use the Platform, and information that is passively or automatically collected from you, such as information collected from the browser or device you use to access our Platform (hereinafter all of these referred to as the “User Information”).

Our platform contains portions where we may need to collect personal information from you for a specific purpose such as signing up in the Platform (“Registration”) as a Merchant or a Buyer by filling the necessary data’s such as creating a username and password or registering using mobile phone number verification and providing necessary details about the User in order to be eligible to access the Platform. In the course of these various offerings, we often seek to collect from you various forms of information, such as: name, address, email, phone number, fax number, age, sex, nationality, Government issued ID cards/number and business details like legal name, trade name, registration number, GST number, PAN, and bank details, and Know-Your-Customer (KYC) details etc. At some instances, you may also be able to submit Information about your business details, business location, geo location, map location etc.

  1. Information that is automatically collected

You can visit this Platform and view without revealing us who you are or revealing any information about yourself. However we, and our merchants or other partners may use automated means to collect various types of Information about you, your computer or other devices used to access our Platform and your Browser (“Usage Data”). The following is a representative, non-exhaustive list of the various types of Usage Data that is automatically collected by us which may include: Your access to the Platform (Desktop, Mobile Web or Apps), network or Internet protocol address, type of browser You are using (e.g., Chrome, Safari, Firefox, Internet Explorer), Browser version, the type of operating system You are using, (e.g., Microsoft Windows or Mac OS), mobile network, device identifiers, device settings, browser settings, the web pages of the Platform You have visited, website or URL visited before and after You visited our Platform, the type of handheld or mobile device used to view the Platform (e.g., iOS, Android), location information, and the content and advertisements You have accessed, seen, forwarded and/or clicked on and other diagnostic data. We use personal information collected through our Platform for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, with your consent, and/or for compliance with our legal obligations.

We may process or share your data that we hold based on the following legal basis, more specifically, we may need to process your data or share your personal information in the following situations:

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We may share your information with certain Maps Platform APIs (e.g., Google Maps API, Place API). To find out more about their Privacy Policy, please refer to their corresponding website. We use certain Maps Platform APIs to retrieve certain information when you make location specific requests. You may revoke your consent anytime by contacting us at the contact details provided at the end of this document. Please be informed that the Maps Platform APIs that we use, store and access cookies and other information on your devices.

We may share your data with Merchants, third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: delivery services, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Services, which will enable them to collect data on our behalf about how you interact with our Services over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, pages or features, and better understand online activity. Unless described in this notice, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes.

These Merchants may use information about your visits to our Platform that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you.

We may share your information with our affiliates, for purposes of providing products and services offered by them, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

We may share your information with our business partners to offer you certain products, services or promotions.

Our Platform is built with security and privacy features to protect your data with us.

If you are under the age of 18 years then you must use the Platform under the supervision of your parent, legal guardian, or any responsible adult. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.
